New! Division of Water Rights - Cannabis Compliance Response Portal
The Cannabis Compliance Response Portal was developed by the State Water Board Division of Water Rights for individuals who were recently contacted by the State Water Board regarding cannabis cultivation activities. The Portal allows individuals to provide information in response to a notice received and potentially avoid additional monetary penalties for continued non-compliance. If you have not received a notice of violation from the Division of Water Rights you are not required to fill out this survey.
New! Update for Onstream Reservoirs/Ponds
The draft Cannabis Policy update, if approved, will allow you to obtain an SIUR for certain onstream ponds. Click here for more information on the proposed Cannabis Policy changes, including how and when to submit your application.
An amendment to the Cannabis Policy is currently being proposed that would allow certain existing (constructed prior to October 2016) onstream reservoirs to be used for cannabis cultivation, with Division of Water Rights and Department of Fish and Wildlife approvals. Currently, the Cannabis Policy prohibits issuance of Cannabis SIURs for onstream storage reservoirs. While not all existing reservoirs will be eligible, the proposed criteria may be found in the Cannabis Policy draft amendment Attachment A, page 44, Terms 79 and 80.
In late December 2018, the Cannabis Application Portal will be updated to allow for filing of water right registrations associated with onstream reservoirs. However, the Division of Water Rights will not be able to issue any Cannabis SIUR certificates for onstream reservoirs until the Cannabis Policy amendment is adopted by the State Water Board and approved by the Office of Administrative Law, anticipated to be April 2019.
